These Terms and Conditions ("Terms") govern your use of Roam Creator, an AI-powered book creation platform operated by Roam Ebooks ("we," "us," or "our") at creator.roamebooks.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

This document is provided for informational purposes and does not constitute legal advice. We recommend consulting with a qualified attorney for guidance specific to your situation.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an account, you represent that you meet this requirement.

2. Description of Service

Roam Creator is an AI-powered book creation studio that guides you from an initial concept to a publish-ready manuscript through a multi-step pipeline. The Service includes:

AI-generated market analysis, character creation, location building, and storyline development
Scene architecture and chapter drafting powered by artificial intelligence
Editorial tools, marketing content generation, and cover design
Manuscript export in DOCX, PDF, and EPUB formats

The Service uses AI models from third-party providers — specifically Google Gemini and Anthropic Claude — to assist with content generation. AI-generated content is provided as a creative tool and may require your review and editing before publication.

3. Account Registration and Security

You may create an account using email and password, Google OAuth, GitHub OAuth, magic link, or passkey authentication.

You are responsible for:

Providing accurate and complete registration information
Maintaining the security of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized access

We strongly recommend enabling two-factor authentication for additional security. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

Current Plans

Founders Plan: $20/month (Early Access pricing, billed monthly via Stripe)

Each subscription tier includes specific AI usage allocations. Additional AI credits may be purchased as one-time token top-up packs.

Pricing Changes

We reserve the right to change pricing with 30 days' prior notice. We will notify you of any pricing changes via email before they take effect.

5. Payment Terms

Subscriptions are billed monthly in advance through Stripe
By subscribing, you authorize recurring charges to your payment method
Failed payments may result in interruption of AI features and Service access
You may manage your subscription (upgrades, downgrades, cancellation) through the Stripe customer portal accessible from your account settings

Refund Policy

All sales are final. We do not offer refunds for subscription periods that have already begun or for token top-up packs once credits have been added to your account.

Account Deletion

When you delete your account, all active subscriptions are automatically cancelled. No refunds are issued for the remaining portion of a billing period.

6. Content Ownership and Intellectual Property

Your Content

You retain full ownership of all original content you create and input into Roam Creator, including your loglines, character concepts, story ideas, outlines, and any edits you make to AI-generated content.

You grant Roam Ebooks a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing the Service. This license terminates when you delete your content or your account.

AI-Generated Content

Content generated by AI through the Service — including chapters, character descriptions, storylines, marketing copy, and cover images — is provided to you as a tool output. You own the final works you create using AI-generated content, subject to the terms of the underlying AI providers:

Anthropic: Under Anthropic's commercial API terms, outputs generated via the API belong to the user
Google Gemini and Imagen: Under Google's API terms of service, outputs belong to the user

We make no guarantees about the uniqueness or originality of AI-generated content. Similar prompts by different users may produce similar outputs. You are solely responsible for:

Reviewing and editing AI-generated content before publication
Ensuring your published works do not infringe on third-party copyrights or trademarks
Verifying the accuracy and suitability of any AI-generated content

Our Intellectual Property

The Roam Creator platform — including its code, design, AI prompt templates, system instructions, and branding — remains the property of Roam Ebooks. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

7. Acceptable Use

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, or defamatory
Create content that infringes on third-party intellectual property rights
Produce obscene or exploitative content, particularly involving minors
Generate spam, misleading content, or content designed to deceive
Attempt to circumvent AI safety filters or content moderation

You also agree not to:

Access other users' data or accounts
Reverse-engineer the AI prompts, system instructions, or pipeline
Abuse AI usage quotas or attempt to circumvent rate limits
Use automated tools (bots, scrapers) to access the Service
Resell access to the Service or its AI features

We reserve the right to remove content or suspend accounts that violate these Terms.

8. AI-Specific Terms and Disclaimers

AI-generated content is produced by third-party language models and may contain errors, inaccuracies, biases, or fabricated information
AI outputs should not be treated as factual, legal, medical, or professional advice
We do not guarantee the quality, accuracy, originality, or fitness for any particular purpose of AI-generated content
AI model versions may change over time, which may affect output quality or style
AI features are subject to availability; third-party API outages may temporarily affect functionality
Your book content is transmitted to Google and Anthropic APIs for processing; by using the Service, you consent to this data transfer
AI usage is subject to monthly quotas based on your subscription tier; exceeding your quota may result in temporary suspension of AI features until the next billing period or until you purchase additional credits

9. Service Availability

The Service is provided on an "as available" basis. We may modify, update, suspend, or discontinue features with reasonable notice. We are not liable for service interruptions caused by third-party providers (including AI APIs, Stripe, or hosting infrastructure).

10. Account Termination

By You

You may delete your account at any time via your account Settings. Account deletion is permanent and irreversible. It will:

Cancel all active subscriptions (no refund for remaining billing period)
Permanently delete all your data, including books, characters, locations, reports, and AI usage logs
Remove all generated cover images from storage

We strongly recommend exporting your manuscripts before deleting your account.

By Us

We may suspend or terminate your account for:

Violation of these Terms
Non-payment of subscription fees
Abusive behavior or prohibited content
Any other reason with reasonable notice where practical

11. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROAM EBOOKS SHALL NOT BE LIABLE FOR:

Loss of data (you should export your work regularly)
Quality or suitability of AI-generated content
Damages arising from third-party service failures
Lost profits, revenue, or business opportunities
Any indirect, incidental, special, or consequential damages

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Roam Ebooks from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

Your use of the Service
Content you create, publish, or distribute using the Service
Your violation of these Terms
Your violation of any third-party rights

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at roamebooks@gmail.com. If informal resolution fails within 30 days, either party may pursue resolution in the state or federal courts located in Wisconsin.

14. Miscellaneous

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Roam Ebooks regarding the Service
Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect
No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision
Assignment: We may assign our rights under these Terms; you may not assign yours without our written consent
Force Majeure: Neither party is liable for failures due to events beyond reasonable control, including natural disasters, war, pandemics, or infrastructure outages

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance. If you disagree with any changes, you may delete your account.
